SMS Terms & Conditions

These SMS Terms & Conditions (“SMS Terms”) apply to the text messages sent by DA Produce Guys, operated by 1710709 Ontario Inc. (“DA Produce Guys”, “we”, “us”) through the “DA Produce Guys SMS Updates” program (the “Program”). By signing up, you agree to these SMS Terms and to our Privacy Policy.

1. The program

The Program sends recurring text messages about fresh produce availability and seasons, new products, market and shipping updates, and offers from DA Produce Guys. If you have asked us for it, we may also send informational messages about your own inquiry or order.

2. How you join, and your consent

• You join by ticking the box “Send me SMS updates” in the sign-up window on daproduceguys.ca and entering your mobile number. The box is never ticked for you.
• Consent is optional. You do not need to agree to receive marketing text messages to make an inquiry, request a quote, or buy goods or services from us. Consent to marketing is not a condition of any purchase.
• By ticking the box and submitting your number you give us your express consent to receive recurring marketing text messages from DA Produce Guys at that number, which may be sent using automated technology. We may send a text to confirm your sign-up.
• You confirm that you are at least 18 years old (or the age of majority where you live), and that you are the subscriber of, or are authorised to consent for, the mobile number you provide.
• Email and SMS are separate choices. Subscribing to or withdrawing from one does not change the other.

3. Message frequency, and costs

• Message frequency varies. You can expect up to about 4 messages per month.
• Message and data rates may apply. We do not charge for the Program, but your mobile carrier’s message and data rates may apply, depending on your plan.

4. How to opt out (STOP)

• Reply STOP to any message at any time. You may also use the words CANCEL, END, QUIT or UNSUBSCRIBE.
• You will receive one final text confirming that you have been unsubscribed, and no further marketing messages will be sent to that number unless you sign up again.
• You can also opt out by emailing info@daproduceguys.ca or calling +1 (519) 953-7177. We act on opt-out requests promptly, and in any case within 10 business days.

6. Where the program is available

The Program is currently offered for mobile numbers in Canada and the United States. If you enter a number in another country, we may not be able to send messages to it. Delivery is subject to your carrier and device. Supported carriers may vary, and carriers are not liable for delayed or undelivered messages. We do not guarantee that every message will be delivered.

7. When we send messages

We aim to send messages between 8:00 a.m. and 8:00 p.m. in the recipient’s local time. If your number changes or you give up your number, please tell us or reply STOP, so that messages do not reach the next person to use it.

8. Your information

• We collect your mobile number, country, the date and time of your consent, the page and method you used to sign up, the wording you agreed to, and your IP address and browser type as proof of consent, as described in our Privacy Policy.
• Our SMS service provider processes your number only to send and manage the messages for us. We do not share your mobile number or your SMS consent with third parties or affiliates for their own marketing or promotional purposes.
• We keep a minimal record (your number and the date you opted out) after you unsubscribe so that we do not message you again, and we keep the record of your consent for as long as the law requires.

9. Canadian and U.S. requirements

• Canada. We send commercial text messages to people in Canada only with their consent, as required by Canada’s Anti-Spam Legislation (CASL). Each message gives you a way to unsubscribe.
• United States. We send marketing text messages to people in the United States only with their prior express written consent, in line with the Telephone Consumer Protection Act (TCPA), the FCC’s rules, the CTIA Messaging Principles and Best Practices, and applicable state laws, including limits on the times of day we may text.

10. Changes to the program or these terms

We may change these SMS Terms or the Program from time to time. The “Last updated” date above shows the latest revision. If a change is material, we will give you notice as the law requires. You may stop receiving messages at any time by replying STOP. We may suspend or end the Program at any time.

11. Governing law

These SMS Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without affecting any rights you have under mandatory consumer or privacy laws where you live.
